Pfizer, the pharmaceutical company that makes Viagra, announced that it has been sued by the plaintiffs for alleged liability under a new settlement agreement.
The plaintiffs, including the firm’s former president and chief executive, and its current president, John C. Lechleiter, filed a lawsuit against Pfizer in October 2011, alleging that they failed to adequately warn the public about the risks associated with the drug.
Pfizer has been under a cloud of controversy since it was founded in 1998 by former Pfizer employees who suffered severe adverse drug reactions after taking Viagra.
In December 2011, a Pfizer subsidiary in Canada, Canada International Pharmacy and Chemicals Canada, filed a lawsuit against Pfizer claiming that it was not properly warned about the risks of Viagra.
The plaintiffs alleged that Pfizer failed to adequately warn about the drug’s risks and the potential for adverse side effects, and failed to include the terms of the agreement with Pfizer, which had not been disclosed to the public.
The allegations of negligence and breach of duty under the agreement were previously rejected in court, and the case is now settled.
The Pfizer litigation was filed in April 2012, and it has already been dismissed by the Canadian court. However, the company still faces similar allegations, and the court will decide whether to approve the settlement.
Pfizer had been the maker of Viagra for years, and its shares of the company have fallen by more than 1 percent since the agreement was announced. However, the company has already been involved in other matters, and the settlement will be subject to legal action by the courts.
“The settlement agreement between Pfizer and the plaintiffs, made with the plaintiffs’ understanding, will be valid and enforceable until and unless the Court grants Pfizer’s motion for summary judgment,” said Lechleiter. “The plaintiffs have no intention of taking any action against Pfizer.”
Pfizer and the plaintiffs have been fighting to keep Viagra off the market. The lawsuits filed by the plaintiffs are not about Viagra, but about a product known as Sildenafil, which was approved by the Food and Drug Administration in 1998 and is the most popular erectile dysfunction drug in the world.
The suit was filed in Canadian courts, and the plaintiffs allege that the alleged negligence of Pfizer caused the plaintiffs to suffer adverse side effects and that Pfizer, in breach of its agreement with the plaintiffs, should be held accountable.
The plaintiffs’ lawsuit filed in Canada by the companies’ former president and chief executive are in the process of filing a lawsuit against Pfizer in Canada, and the plaintiffs have already filed a motion seeking a ruling on whether the settlement should be approved. In order to be eligible for a settlement, the plaintiffs must meet certain criteria, including that they meet the following criteria:
Pfizer has been accused of numerous other serious violations of the settlement, including:
Pfizer has agreed to pay $2.6 billion to settle the litigation and to pay a further $3 billion to settle the litigation. The agreement was announced on the company’s website, with shares of Pfizer trading at around 2.9%.
The settlement is not to be taken lightly, and the plaintiffs have already filed a motion seeking an order to be prepared for the suit.
The company has been paid approximately $3.2 billion by the plaintiffs, but the amount will be reduced as of May 2012. Pfizer is not likely to pay $3.2 billion to the plaintiffs for its settlement.
The settlement has been filed with the U. S.
